Terms and Conditions, Effective 12/01/2021

Customer participation in Stir Studio Kitchen, as a whole, is subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, do not enter into any transaction. Basic definitions in this document: (1) “Stir Studio Kitchen” or "Stir" means Stir Studio Kitchen, LLC, an entity incorporated in the State of Ohio; (2) “Site” means www.stirstudiokitchen.com; (3) “Our(s),” “We,” and “Us” means Stir Studio Kitchen, the Site, and extends to the business together with all owners, partners, and employees; (4) “You(‘re),” “Your,” or “Customer” mean a website visitor/user, account holder, class purchaser, class participant or any other user of our Services; (5) “Service(s)” means use of and anything provided on our Site, excluding third party links, and attendance, participation in, product(s), and any instruction offered and/or provided by/at Stir Studio Kitchen. “Service(s)” also includes any other product or service that we offer or provide to you that references this Terms and Conditions Agreement (“Terms”).

Privacy Policy

Unless you willingly opt in by subscribing to the marketing list provided on our Site, Stir Studio Kitchen does not add your email address to mailing lists, nor does Stir Studio Kitchen use your personal information for any marketing purpose. Stir Studio Kitchen does not share your email address or any other private information about you with others, except as required by law. By attending a cooking class or event, you are granting Stir Studio Kitchen permission to use photographic and/or video images of you for the purpose of marketing, publicizing, and promoting Stir Studio Kitchen. Attending class waives any right to be compensated for the use of my image and releases Stir Studio Kitchen from liability for any claims, where such claims arise out of or relate to Stir Studio Kitchen’s use of your image. 

Limitation of Liability

You agree to the fullest extent allowed by law, to release any and all claims you may have against us, our owners, managers, members, employees and other representatives (hereinafter, “Agreement Beneficiary”) relating to or arising out of any property damage, personal injury or illness you may incur while attending or participating in a cooking class. You also agree to pay any costs, including reasonable attorney’s fees incurred by any Agreement Beneficiary to enforce these Terms. You consent that these Terms are deemed to have been made in the State of Ohio and Ohio law will apply to interpretation and enforcement.

You hereby release and agree to hold Stir Studio Kitchen harmless from, and waive on behalf of yourself, your heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to yourself and/or property that may be caused by any act, or failure to act of Stir Studio Kitchen, or that may otherwise arise in any way in connection with any services received from Stir Studio Kitchen. You understand that this release discharges Stir Studio Kitchen from any liability or claim that you, your heirs, or any personal representatives may have against Stir Studio Kitchen with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Stir Studio Kitchen. This liability waiver and release extends to the business together with all owners, partners, and employees.

Cancelation Policy

As it pertains to public classes at Stir Studio Kitchen, a Customer may cancel his or her reservation, or one on their behalf, up to 24 hours before the scheduled class and receive a full credit less processing fee. Processing fee is determined by Stir and made known to Customer prior to the original purchase and may change from time to time. Credit is issued in lieu of cash refund. Credit can be applied toward the purchase of a future product or service of Stir within a 365-day period from the date of issuance. Stir does not issue credits within 24 hours of any class or for absent guests.

As it pertains to private group events in which Customers pay separately, a Customer may cancel his or her reservation, or one on their behalf, up to 24 hours before the scheduled event and receive a full cash refund less processing fee. Refunds will be issued only insofar as the predetermined group minimum is maintained. In the event cancelations are requested in default of the group minimum, Stir is entitled to retain the cash value of the predetermined group minimum, and Customer(s) is (are) entitled to reschedule the event and apply existing cash value of the predetermined minimum (and any amount exceeding such) to the rescheduled event. Stir does not issue refunds within 24 hours of any event or for absent guests.

As it pertains to private group events in which Customers pay as a whole and by means of a deposit and reconciliation, a Customer may cancel his or her reservation, or one on their behalf, up to 24 hours before the scheduled event and forfeit their deposit. In such case, Stir is not entitled to collect the balance or reconciliation of the purchase. Should the Customer choose to reschedule the event, Stir may or may not, at its sole discretion, apply the deposit to the rescheduled event. Stir is entitled to collect the balance, and retain the deposit, of any cancelation requested within 24 hours of any event or for absent guests.

Stir Studio Kitchen reserves the right to cancel any class or event for any reason and at any time at its sole discretion, upon which Customer is entitled to receive either a full credit or full refund at his or her sole discretion.

As it pertains to any and all cases not defined herein, Stir Studio Kitchen is obligated to resolve the case with fair and reasonable effort.

Gift Certificate and Credit Policy

Gift certificates and credits may be redeemed for all products and services of Stir Studio Kitchen unless otherwise noted at the time of issuance. Gift certificates and credits are not specific to each studio. Gift certificates do not expire.

All gift certificates and credits are transmitted digitally with an associated redemption code. The redemption code, on its own, represents the cash value of the underlying purchase.

Gift certificate and credit redemption codes are not specific to any individual. Redemption codes may be used by individuals other than the intended recipient(s). Stir is not liable for the unauthorized use of a redemption code by an individual other than the intended recipient.
